Van de Vliert, W.F.G.Mastenbroek. Negotiation.
Authors, as against the majority of the researchers, considering negotiations as interaction of two parties, include negotiations between three and more by parties
Under "interest" authors understand the basic aspirations and motives, driving by the contract. parties and directly connected with result of negotiations directly
In the chapter, devoted motivation and satisfaction from negotiations, is shown, that results of negotiations (both positive, and negative) and, accordingly, the interests of the contract. parties can be most various. Ways are various also, with the help of which the participants of negotiations achieve that or other result.
By concept "negotiations" we designate process, at which all participants voluntary and consciously agree on acceptance of the common decision concerning distribution between them of means and profit or concerning an exchange of means and profit. In other words, about negotiations it is possible to speak at presence of the following conditions:
1. Interests of the contract parties, connected to particular result, are opposite each other.
2. For achievement of this result it is necessary, that the parties worked together.
3. The result assumes reception of the certain profit and investment of certain means.
4. The purpose of negotiations consists in achievement of the agreement between the parties, though is not limited by this agreement. The results of negotiations can have the form of the compromise, productive rapproachement of opposite interests, complete capture by one of the parties, temporary suspension of further activity, obvious split and etc..
The agreement can be achieved by distribution of the profit or expenses (money, credit, raw material, working hours, working conditions, obligations in relation to the third party) or exchange of profit or expenses (money in an exchange on raw material, working hours in an exchange on working conditions and etc.)
Dominic J.M.Nellissen. Mediaion.
The author of the article - expert on mediation and bargaining in Holland advocat firm.
This article is the text of report on 6-th Internatianal workshop " Social conflict and organization development " in Kaluga in May of 1996. The author propose to look at the concept of mediation - as a process in wich a neutral third party, the mediator, assist two or more party to reach a voluntary negotiated settlment of their differences. The neutral third party, the mediator, use the variety of skills and techniques to help the desagreement parties to reach a settlement, without, unlike a jadge or an arbiter having any power to make a decision for them. He makes other people conclude for themselves.
The author compare the procedures mediation, negotiation, arbitration and litigation on many differential levels to base, that negotiation is the best way to resolve yuor dispute. But if the parties are not capabale of reaching a settment on their own, the best choice is for mediation.
The athor using the “Harvard method” by Fisher and Ury and saying about four basic rules:
separate the people from the problem
focus on interests, not on positions
invent options for mutual gain
insist on using objectiv criteria
And in the final part of the article the author demonstrated several techniques of mediation.
